I Got A Final Admission Of Liability, What Do I Do? – The final admission of liability is one of the most important documents you can receive during your Workers’ Compensation case.
Most injured workers believe their case can’t be closed because they think they have to cash a check or they have to sign something to agree to allow their case to close, but that’s not how it is.
Why is the Final Admission of Liability so important?
This document might be confusing and dense. It has a lot of words, and people don’t know what it means. However, the important part is that if you fail to do something with it within 30 days of it being sent to you, then your case can be closed. This means that all the rights that the carrier has admitted within that document are all you will get, and you don’t have the ability to dispute them.
What do I have to do when I get it?
You have to do several things when you get a final admission. First, you must object to it in writing. Then, send that objection to the state of Colorado and, additionally, send it to the insurance company.
Furthermore, you have to decide whether or not you’re going to fight the treating physician’s impairment rating. There’s another form for that. If there are issues or benefits they didn’t admit to or that they did admit to but paid too little, you also have to make an application for a hearing.
There are so many things to do when they give you these notices, and it is not very clear how to do them. If you don’t do all these things correctly on time, your case closes.
Unfortunately, too often, people don’t do anything with this form. Then they come to us after the 30 days have expired, and we can’t do anything for them because they failed to do something with this document.
