We’ve attended conferences where treating doctors are told that the majority of injured workers are fakers and exaggerators, so a lot of these doctors think it’s their job to figure out who are the lairs.

Be aware during your whole visit

Everything you say and everything you do even if you’re not with the doctor it’s going to be observed. You have to be very aware of your surroundings, if they can watch you as you get out of your car and go into the waiting room, as you go from the waiting room into the examining room, they’re watching you at all times.

The reason why they’re watching you is to see how you appear and how you behave when you’re not being examined versus when you are, all of this is to help the insurance carrier deny a claim.

The importance of what you say and what the doctor writes down

Even if you report your injury and they don’t send you to a doctor so you go to your own family physician, that first medical visit and what that doctor writes down is critical.

If you say you don’t know how the injury happened and you just woke up with pain, you will lose, if you say you got injured at home you will lose.

Also, many people get injured and they suffer multiple injuries, and the ones that cause more pain are the ones they complain about the most, so the patient is focusing on that which is the most painful but forgets about the other injuries they may have sustained.

The problem with that is upon the first reporting of the injury all the doctor writes down is the one injury that the patient was focusing on and not the other ones, which may start to cause more pain afterwards, so for example, when they go back to the doctor a week later, they at first, reported a knee injury, but then they report a back injury or a neck injury.

The insurance company won’t want to take responsibility for that and will ask if you were truthful and told the doctor everything that hurt, and even if you did, if the doctor didn’t write it down, they will say that since it’s not written then those other pains are not a result of the work injury.
