Can a provider bill me if I have Workers’ Compensation?
When you receive medical care, Colorado providers have to accept the Colorado medical fee schedule, which is what they can charge, and the medical provider can’t charge you the difference.
For example, if you receive physical therapy that normally costs $150, but the fee schedule says the insurance company only has to pay $100, the medical provider can’t charge you the $50 that Workers’ Compensation didn’t pay.
Medical providers have to accept the money that the fee schedule sets for reimbursement for their services.
What can I do to not get medical bills after my injury?
To be protected from medical providers trying to charge you the difference or trying to collect from you because Workers’ Compensation hasn’t paid, you need to make sure you have an admitted case.
Additionally, you could think your case is admitted, and thanks to that,t you’re getting medical care, but that’s not true; you can get medical care and not have an admitted case. You need to make sure that the insurance company files a formal admission, typically called a general admission of liability.
You might also get bills not because the provider wants you to pay for it, sometimes they’re just sending you a copy of what the insurance company is getting sent, only for your information. If it’s not clear whether they’re asking you to pay, call them to be sure they’re not trying to charge you.
A medical provider rarely insists they want you to pay when there’s a general admission of liability, but if that happens, we can go after them for penalties for violating the law.
