What to Do If Your Employer Lies About Your Work Injury – There might be people at work that you think you know, people that you can trust, and they have your back, but when you’re injured on the job, things might be different.

What if your employer lies?

One of the biggest frustrations injured workers face when dealing with litigation in a Workers’ Compensation case is that, essentially, everyone lies, and too often it becomes a “he said, she said” fight.

You might be injured at work, and you told your boss about it, but what if your employer lies and says you never reported the injury? If your employer denies that you reported your injury and they say you just stopped showing up to work without explanation, how could it be proven that they’re not telling the truth other than having you testify?

The most common answer our clients give to that question is that their boss knows, and their coworkers were there, so they know too. However, we often find that coworkers won’t help because they won’t testify against their boss, as they’re still working there and need the job.

How can you prove you’re telling the truth?

When you’ve been injured on the job assume that everyone will lie about what you said or what you did, so you should put it in writing, a text or an email, for example, “just following up on whether or not you’ve got a doctor for me to see for my injury when I threw out my back lifting those boxes”, that will prove that you reported it and no one will be able to lie about what was said.

Another great way to prove something happened is by taking photos. For example, they might say that they never told you that you had to lift more than 40 pounds, but you can show pictures of the boxes you lifted that weighed more than 40 pounds, proving that they did.

You can also take videos, and even record conversations, the law in Colorado says that as long as one person in the conversation agrees to that conversation it can be recorded without disclosing it to everybody else, so if you’re talking, you can record it, but be specific, it’s not enough to say your back hurts, you must say, for example, that your back hurts because you were lifting the boxes at work yesterday.
