Understanding a Final Admission of Liability – When injured workers contact our office, the number one thing we’re most concerned about is whether or not they’ve received a final admission of liability.
What is the final admission of liability?
The final admission of liability is an important legal document listing the benefits you have been or will be paid, and you have a right to disagree to it.
Once that document has been filed and sent to the address of record, you have 30 days to file a written objection if you disagree that you are not cured or at maximum medical improvement, or what sort of compensation you should get for your injury.
The danger of waiting
With the final admission of liability, the insurance company is stating what they have paid, what they will pay, and nothing more, if it’s not on that document they won’t pay it, and your case will be closed automatically within 30 days unless you do something. They do not require you to agree to it or to sign off.
Once that time has passed, your bargaining position collapses because your claim is closed as to everything that the insurance company has decided to give. Whatever they haven’t decided, they are no longer obligated to provide you and you won’t be able to pursue in court.
Oftentimes, if the adjuster is putting you off saying they will get back to you, they are just waiting for the 30 days to pass.
